3 Our Contract with You


Our website pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

We also accept orders by telephone. If you would like to order any products by telephone, please call 01978 280252 and one of our representatives will guide you through the steps you need to take to place an order with us.

4 Order Acceptance 

After you place an order, you will receive an email from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place when we email you confirming the products have been dispatched (dispatch confirmation), at which point a contract will come into existence between you and us.

If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. If you have already paid for the products, we will refund you the full amount including any delivery costs charged as soon as possible.

We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

We deliver our products to addresses in the UK and within the European Union. 


5 Website Information and Print Errors
All information on our website, including prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions. The website is under continual development and manufacturers may change specifications, conformities and pricing without giving notice. We endeavour to keep track of these changes and keep the website information accurate. We reserve the right to alter our prices and specifications without notice.  R3 Safety and Rescue Ltd gives no warranty or assurance about the content of the website. 

6 Payment
We accept all major credit and debit cards as well as PayPal. Payments made on-line are taken securely by Shopify Payments and / or PayPal. R3 Safety and Rescue will never see your bank or credit card details.


7 Ownership of Goods
All goods supplied to the customer remain the property of R3 Safety and Rescue Ltd until final payment of all sums owing in respect of those goods has been received in full by us and the funds have cleared.
 

8 Delivery Details

All UK mainland (excluding Scottish Highlands) orders over £500.00 ex VAT will receive free next day delivery.   

 

Orders to the Highlands and Islands may be a two day delivery and overseas will be longer. We cannot be held liable for any consequential loss caused by late delivery, or failure to deliver.

 

Please note that orders placed after close of business (16.30 hours) Monday to Thursday will be processed the next day. Orders placed after close of business (16.00 hours) on a Friday or at a weekend will be processed on the Monday.

 

EU orders are supplied on an ex-works basis.  We will agree shipping charges with you to ensure your order is dispatched in a timely and satisfactory manner. The customer is responsible for all costs and duties applicable.

Goods will be delivered, by our appointed carrier, to the address given by you on the order form. It is important that this address is accurate. In most instances the parcel will not be left without a signature. If you ask for your delivery to be left somewhere without a signature then this is done at your own risk, we will not be liable for the theft / loss of your package. Please provide us with a delivery address where the parcel can be signed for between the hours of 8:00am and 6:00pm. We cannot be held liable for any consequential loss caused by late delivery, or failure to deliver by our appointed carrier.

Shipping Costs
You can view your postage cost at the ‘My Baske’t stage by simply entering your delivery postcode and country into the calculate delivery cost section. Should any goods delivered by us be damaged in transit, deficient of items shown on the delivery note or failing to match the items ordered by you, then you must notify us in writing within three working days of receipt. If we receive no such notification, you will be deemed to have accepted the items as satisfactory.

 

Collecting from Store
Items can be collected from our store anytime from Monday to Friday between 09.00 hours and 16.00 hours (excluding Bank Holidays and Christmas / New Year shutdown). Please call us to confirm the day and time you would like to collect so we can have your items and paperwork ready for your arrival.

 

 

9 Cancellation and Returns Policy

 

Once accepted, an order may not be cancelled without our written agreement and on

terms that you indemnify us in full and against all loss (including loss of profit) and

expenses incurred as a result of cancellation.

 

We will not be liable to you or be in breach of contract by reason of delay or failure to

perform any of our obligations if the delay or failure was due to any cause beyond

our reasonable control.

 

 

If you wish to receive an exchange or refund, we need to be notified within 21 days of you receiving the goods and require the product to be unused and in exactly the same condition that it left us i.e. in its original and undamaged packaging and with the tags / labels still attached and fit for re-sale. If the tags/labels have been removed then the item is not returnable under any circumstances.  Goods must be returned to us at your own expense and must be adequately packaged to protect against damage. If you fail to take reasonable care of the goods before they are returned to us, or have used insufficient packaging to return them to us and this results in damage or deterioration, the item will be returned back to you. We recommend that all items returned to us be sent recorded delivery with insurance paid as a minimum. 

If we have sent you the wrong item or the item has arrived faulty or damaged, or if the item has been dispatched as ordered, but is unwanted due to the description on the website being incorrect or misleading, you must notify us in writing within three working days of receipt. If we receive no such notification, you will be deemed to have accepted the items as satisfactory.

 

 

Where on investigation R3 Safety and Rescue agrees the incorrect quantity was delivered

or the goods were damaged, we shall ensure the correct quantity is supplied and the

customer will return any over- supply (at our expense) and/or we shall replace the

damaged goods with undamaged and this shall be the customer’s only remedy in such a

case.

The customer shall return any damaged goods to R3 Safety and Rescue at the

customers expense. Where we agree after inspection that the goods were damaged we

shall refund the carriage costs of such return to the customer, but not otherwise.

 

All risk in the goods shall pass to the customer upon delivery.

 

 

10 Information, Advice and Performance including Hazardous Activities

 

 

It is entirely the customer’s responsibility to ensure that the kind and/or class of goods ordered by you are suitable for your purpose. You shall not place any reliance on our skill or judgment or that of our employees or agents in respect of the goods. We shall not be under any liability for any loss or damage however arising from or attributable to any advice, statement or representation given by us, our employees or agents to you in respect of the goods whether regarding performance, capability or suitability for any purpose. Such liability is expressly excluded to the fullest extent permitted by law.

 

The goods supplied by the company are used in rescue operations, working at height,

working in and near water and similar or associated hazardous activities.  Where goods are

used for hazardous activities the company does not take responsibility for their use.  Goods

used for hazardous activities should only be used by competent, informed and fully trained

people who accept the risks involved. Training in appropriate techniques and safety

measures is the responsibility of the user of the goods and the company does not assume

any liability for risks, damage or injury which may arise from the use of the goods in

hazardous activities.

 

It is the responsibility of the customer to ensure that all technical data and instructions

provided with the goods by the company is supplied to the end user.

 

11 Limitation of Liability

 

 

Except in respect of death or personal injury due to negligence for which no limit applies, the entire liability of the company to the customer in respect of any claim whatsoever or breach of this agreement, whether or not arising out of negligence, shall be limited to the price paid by the customer to which the claim relates.

 

In no event shall the company be liable to the customer for any loss of business, loss of

opportunity or loss of profits or for any other indirect or consequential loss or damage

whatsoever. This shall apply even where such a loss was reasonably foreseeable or the

company had been made aware of the possibility of the customer incurring such a loss.

 

Nothing in these Terms and Conditions shall exclude or limit the company’s liability for

death or personal injury resulting from the company’s negligence or that of its employees,

agents or sub-contractors.

 

12 Guarantee

 

We give no warranty either express or implied as to the goods. You shall only be entitled to the benefit of such warranty or guarantee as is given to us or you by the manufacturer.

 

 

13 Tax Charges

VAT at the current rate applies to all orders dispatched for delivery within the UK and will also be charged on any EU order where we do not have the customer's VAT number.

14 Privacy and Cookies

R3 Safety and Rescue is committed to protecting your privacy and complies with the Data Protection laws applicable to the UK. How we handle your information is outlined in our GDPR Policy.

Your details will not be passed or sold to other companies for marketing or mailing purposes.

We do use the information we collect about you to process your requests and to provide you a more personalised internet experience. We monitor web site traffic patterns and usage to help us determine which aspects are of most importance to you and to develop the web site design and its layout.

This web site sets "Session" cookies, essential for the operation of the web site which are used to 'remember' user specific information only during the time that a user is using the web site. This privacy policy sets out how R3 Safety & Rescue Ltd use and protect any information that you give us when you use our services (training provision or equipment supply).  We are committed to ensuring that your privacy is protected.

Should we ask you to provide certain information by which you can be identified when using our services, then you can be assured that it will only be used for the purpose intended by you.

This policy sets forward how we will control or process any personal data that we collect in accordance with GDPR. Any data that we process for 3rd party companies will be in line with their own privacy policy.

        1. The processing of your personal data is required in order for us to fulfil our contract with you as a training provider or equipment supplier
        2. All personal data is stored on cloud systems to ensure their hosting and processing is completed in European datacenters

        4. You have the right to lodge a complaint with the Managing Director or nominated deputy should you feel that we have processed your data incorrectly.

        6. Some of your personal data will be processed through automated processes such as exporting information to our accrediting body.
